Well first of all, obviously, you have been accused of a Sacramento drunk driving violation. If this is the case a Sacramento DUI attorney’s expertise can benefit you in the regard of avoiding  a  DUI conviction and/or saving you thousands of dollars in fees and hour of aggravation. A California DUI lawyer specializing in DUIs, and has been for many years, knows the ins and outs of California’s DUI laws which enables them to build a case for you that will either free you of a conviction or at the very least work out a deal with the prosecutor to minimize your sentence. They can find the technicalities involving your drunk driving case that could have the charges dropped. Also, many times, Sacramento DUI lawyers know the judges and prosecutors in court by dealing with them every week and this alone can benefit you. Corrupt, I know, but it’s the way it is. When there is no avoiding a conviction and/or penalties because of the manner you were arrested (e.g you admitted to being drunk, failed sobriety test, and were violating traffic laws prior to being stopped) a Sacramento DUI attorney’s services can still benefit you very much.

If you were convicted or pleaded guilty your lawyer will be able to help you get your DUI charge expunged. To have a DUI expunged from a suspect’s permanent record requires a variety of things to happen, including the state of the charge and where the charge was originally filed. If you have had your license suspended by California, your lawyer will be able to appeal the license suspension and have the license reactivated before heading to court. In this case you can continue driving until the case reaches trial, in which the judge could decide to suspend your drivers license for a specific period of time. If this was your first DUI offense your lawyer can in all likelihood have the charge reduced to reckless driving, which carries much lighter penalties.

In summary, if you are worried about the fees of a Sacramento DUI lawyer they will probably save you that amount of money by having your fees reduced, saving you time or helping you avoid any penalties at all. Any good Sacramento DUI lawyer offers a free initial confidential consultation and tells you the cost of their services up front.

While I have no specific details of Sacramento DUI checkpoints or numbers of law enforcement officials that will be patrolling on the 4th I must warn you not to drink and drive.

Holidays, especially the 4th of July are when DUI patrols make the most arrests not only because more people drink and drive, but becuase the have their eyes wide open on these dates and their number double. If you’re drinking on the 4th make sure to call a cab(always a good idea.)

Hospital emergency rooms have long been a place where lives are saved on the spot. A new program being developed by the UC Davis Trauma Prevention Program will extend that lifesaving work by making sure law enforcement agencies know the blood-alcohol content of patients admitted after alcohol-related vehicle crashes.

When the system is fully developed, the Trauma Prevention Program will provide education on uniform and consistent reporting procedures at all 11 level I and level II trauma centers in inland Northern California. In addition, UC Davis Medical Center will develop a standardized hospital procedure for obtaining a legal blood-alcohol level and teaching it to the same trauma centers.

“Our project aims to help increase the number of DUI convictions for drivers involved in alcohol-related collisions,” said Christy Adams, program coordinator for the Trauma Prevention Program. “Increased convictions can ultimately lead to fewer alcohol-related crashes in the future.”

California DUI Checkpoints During the Holidays

   Posted by: duinick

The holiday period is upon us, and with it come the litany of reminders to not drink and drive.

The 21 police agencies in Alameda County are ramping up their anti-DUI efforts in the coming weeks to keep the roads safe during the holiday season.

The California Highway Patrol, as well as police departments in Fremont, Newark and Union City, are participating in the Avoid the 21 campaign, an effort named for the participating agencies in the county.

Officers on Friday began roving the streets and highways looking for drunken drivers, organizers said. They will continue to do so through the new year.

In addition, sobriety check points have been established in two cities.

Fremont police will man a checkpoint from 7 p.m. to midnight Tuesday on Thornton Avenue at Cabrillo Drive.

Officers will be looking for impaired drivers, as well as checking for valid driver’s licenses.

A similar operation will be held in Newark on Dec. 26. The location of that stop has not been established.

No checkpoints have been scheduled in Union City.

The anti-DUI efforts are funded by a grant provided by the California Office of Traffic Safety through the National Highway Traffic Safety Administration.

Since 1998, the first year of the program, authorities have removed more than 6,000 intoxicated drivers from the state’s roads.

3 Important California DUI FAQ

Source: Lawrence Taylor

Q.When a police officer pulls me over and asks if I had been drinking, how should I answer him?

A.By law, an individual is not required to answer any questions that could incriminate them. An individual is allowed to ask to speak with an attorney before answering any questions. If you do state that you have been drinking, you are putting yourself in a dangerous position.

Q. When a police officer asks me to follow a penlight what does he look for?

A.This test is called the horizontal gaze nystagmus (HGN) test. Nystagmus is the medical term that describes a particular eye oscillation. The steadiness of the eyes while following the pen and the degree at which the eyes begin to move erratically indicate the level of alcohol in the blood of the suspect. The police officer attempts to determine if the angle of the eyes are less than 45 degrees. An angle of less than 45 generally indicates a blood-alcohol level of .05% or greater.

The horizontal gaze nystagmus test is still fairly new and has not been accepted for use in many states. Many medical professionals don not consider this test to be credible. It is also possible that some police officers performing this test are not qualified to administer the test. The untrained officer may not be able to negotiate the proper angle and hence misjudge nystagmus. Although approved in other states, this test is not accepted for use in California.

Q.Can I choose with chemical test I can take?

A.In California, the most popular choices are the breath and blood tests. Should a breath or blood sample not be available or there be a suspicion of drug use, a urine test could be taken as an alternative. Many officers do not inform suspects that they can have a blood test taken after the breath sample is taken.

Blood tests are the most accurate of the chemical tests. The technology used in the breathalyzer is known for its flaws and errors that create inaccurate test results. The urine test is the least accurate of the choices.
