Six Injured in Suspected California DUI

Posted by: duinick    in California DUI Arrests

Police arrest a woman they say caused an accident while driving without a valid license, and under the influence of alcohol.

It happened on State Route 154 at Paradise Road at about 10:15 p.m. Sunday. The California Highway Patrol says 28-year-old Adriana Ponces of Newbury Park crashed into another vehicle while she attempted to make a left-hand turn at a stop sign.

The CHP says Ponces had four passengers in the car. The driver of the other vehicle had no passengers.

All six people were taken to the hospital for minor to major injuries.

Under California DUI law the suspect can face a broad range of penalties. She would be well advised to contact a California DUI lawyer.

The director of Cal Fire has been arrested on suspicion of driving under the influence of alcohol.

“I am letting you know of my arrest, because I believe you should hear it from me first. I intend to examine why this happened, and I assure you it will never happen again. I have let you down, and for that I am profoundly sorry,” Walters said in a statement.

Cal Fire said Walters has agreed to a probationary period of 120 days, and will seek advice and counseling from the state’s Employee Support Services.

Walters will continue full-time in his position, but will be required to provide updates on his progress.

Schwarzenegger appointed Walters to head Cal Fire in July 2008. He began his career as a firefighter in 1971.

Sacramento DUIs

Posted by: duinick    in Sacramento DUI

The criminal case filed against Sacramento DUI defendants consists of two different statutes: California Vehicle Code Section 23152 (a), and Vehicle Code Section 23152 (b).

The first count focuses on whether the driver was under the influence of alcohol or drugs to the extent that they are “unable to drive their car with the same caution characteristic of a sober person, of ordinary prudence, under the same or similar circumstances.” This is the legal standard for being considered under the influence of alcohol or “DUI” in California courts.

The second count, known as the “per se” charge, concentrates on whether the driver’s blood alcohol content (BAC) was .08 percent or greater. Based purely on body chemistry.

Even motorists licensed in other states who are arrested for DUI / DWI in Sacramento must request a California DMV hearing to protect their driving privileges.

Sacramento DUI Checkpoints Next 2 Weeks

Posted by: duinick    in Sacramento DUI

Law enforcement agencies throughout the Sacramento Area will be targeting drunken drivers during the next two weeks with checkpoints and saturation patrols throughout the region.

In 2008, 1,029 people died in alcohol-involved collisions in California, according to the state’s Office of Traffic Safety.

A Sacramento Police Officer has been booked for Sacramento DUI. The officer fell asleep at the wheel, fox40 reports.

Firefighters were the first on scene. They called the police when they suspected the officer had been drinking.

“There are over 1,100 men and women in this department and we’re all human. However we do expect our officers to hold themselves to a higher standard,” Sgt. Konrad Von Schoech said.

“What I can tell you is that a thorough and concise administrative investigation will be conducted by the Sacramento Police Department. And at the conclusion of that investigation, appropriate action will be taken,” Von Schoech said.

The Livermore and Brentwood police departments are planning to hold sobriety and drivers license checkpoints over the next seven days.

The DUI checkpoints will be held in areas with a high occurrence of DUI crashes or arrests. All drivers should expect to be delayed for a moment while an officer checks to make sure their license is current and looks for signs of drunkenness.

The Livermore checkpoint will be held in the evening hours of Saturday, and the Brentwood checkpoint the following Friday, Aug. 21.

Both DUI checkpoints will be paid for with grants from the California Office of Traffic Safety.

Authorities said a California Highway Patrol officer traded shots with a suspected drunken driver and passenger early Sunday, but no one was hurt and no arrests have been made.

The officer flashed his emergency lights to pull over the suspect’s car around 3:30 a.m. on Interstate 8, and they came to a stop on Second Street and Madison Avenue, CHP Officer Brian Pennings said.

“Both the driver and passenger ran and a shooting ensued,” Pennings said.

One of the occupants of the vehicle fired a gun, and the officer returned fire, but apparently no one was hit, according to Pennings.

He said one of the occupants got back in the vehicle and sped off, and the car was found abandoned on Highway 125 between Lemon Avenue and Spring Street.

Sheriff’s Lt. Gary Steadman said there was a considerable deployment of deputies in the area searching for the suspect.
